Terms of Use
Effective 27 September 2026 · Version 2026-09-27
1. About these Terms
These Terms of Use govern access to and use of Scene Click, including the private Beta, website, applications, generation tools and related services (the Service). Scene Click is operated by Minmud Pty Ltd, Australia (we, us or our).
By creating an account, joining the Beta where acceptance is requested, or using the Service, you agree to these Terms. If you use the Service for a company or other organisation, you confirm that you have authority to accept these Terms on its behalf.
2. Beta service
Scene Click may be provided as a private, preview or Beta service. Beta features may be incomplete, change without notice, contain errors, be unavailable from time to time, or be withdrawn. We may limit access, usage, generation volume, features or storage while the Service is in Beta.
You should not rely on Beta outputs as the sole basis for safety-critical, legal, financial, engineering, construction or other high-risk decisions.
3. Accounts and access
You must provide accurate account information and keep your login credentials secure. You are responsible for activity carried out through your account unless caused by our breach of law or security obligations.
Access may be invite-only. An invitation is personal to the intended recipient unless we expressly agree otherwise. We may suspend or restrict access where reasonably necessary to protect the Service, other users, our systems or third parties.
4. Your content
You retain any rights you have in images, product photographs, prompts, text, files and other material you upload or submit to the Service (Your Content).
You grant us a non-exclusive, worldwide licence to host, copy, process, transform and transmit Your Content only as reasonably necessary to provide, secure, maintain and improve the Service, comply with law, and provide support requested by you.
You must have all rights, permissions and consents needed to submit Your Content and to allow us to process it for those purposes.
5. Generated outputs
The Service uses automated and artificial-intelligence systems to create or modify images and other outputs. Outputs can be inaccurate, incomplete, visually implausible, or similar to material generated for other users.
As between you and us, we do not claim ownership of rights you may have in outputs generated for you. Your ability to own, use, register or enforce rights in an output depends on applicable law, the nature of the output, Your Content, and any relevant third-party rights or provider terms.
You are responsible for reviewing outputs before publication, sale, advertising, manufacturing, construction, procurement or other reliance.
6. Acceptable use
You must not use the Service unlawfully, infringe intellectual property, privacy or other rights, upload material you are not entitled to use, attempt to gain unauthorised access, interfere with security or operation of the Service, reverse engineer protected parts of the Service except where law permits it, or use automated means to abuse usage limits, credits, invitations or access controls.
You must not represent an AI-generated or altered image as a verified statement of fact where doing so would be misleading or unlawful.
7. Third-party services
Scene Click may rely on third-party hosting, storage, authentication, payment, communications and AI model providers. Those services may process data on our behalf or impose technical restrictions that affect the Service.
Where a third-party service has terms that apply directly to you, you are responsible for complying with them. We remain responsible for our own obligations under applicable law.
8. Fees, credits and plans
Some features may later require payment, a subscription or generation credits. Any applicable price, included usage, renewal terms and material limits will be shown before you purchase. We will not charge you merely for joining the Beta waitlist.
Unless stated otherwise at purchase, credits are a usage accounting unit rather than stored money and are not redeemable for cash. Nothing in these Terms excludes any refund or other right you have under the Australian Consumer Law.
9. Intellectual property in Scene Click
We and our licensors retain all rights in the Service itself, including its software, interfaces, branding, workflows, documentation and technology, excluding Your Content and any rights you may have in generated outputs.
These Terms give you a limited, non-exclusive, non-transferable right to use the Service while you have authorised access.
10. Privacy
We handle personal information in accordance with applicable privacy law and our privacy notices and policies. These Terms are not intended to replace any privacy notice or consent that must be provided separately.
You should not upload sensitive or confidential material unless you are authorised to do so and are satisfied that the Service is appropriate for that material.
11. Service changes and availability
We may change, improve, suspend or discontinue features of the Service. Where a change materially affects a paid service, we will provide any notice or remedy required by law or by the terms presented when you purchased that service.
We do not promise uninterrupted or error-free operation, but this does not limit rights that cannot lawfully be excluded.
12. Consumer guarantees and liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot be excluded under the Australian Consumer Law or other applicable law.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, loss of profits, loss of opportunity or loss arising from reliance on unreviewed AI outputs. Where liability can lawfully be limited, our liability is limited to the extent permitted by applicable law.
13. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate access if you materially breach these Terms, misuse the Service, create security or legal risk, or if we discontinue the relevant Beta or service.
Terms that by their nature should continue after termination, including provisions about intellectual property, liability and governing law, continue to apply.
14. Changes to these Terms
We may update these Terms as the Service develops. If a change is material, we will take reasonable steps to notify affected users and, where appropriate, ask for renewed acceptance. The effective date shown on this page identifies the current version.
15. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the courts of New South Wales and any courts entitled to hear appeals from them, subject to any rights you have to bring a claim elsewhere under applicable consumer law.
